Waffle House is under fire after a Florida man claims they violated the Fair Credit Reporting Act when he was denied employment based upon the information found in his background check was reviewed.
The plaintiff in the case against Waffle House is William Jones, who claims to have applied for a position at one of the chain’s Orlando locations in December 2014. According to reports, the restaurant conducted a background screening and subsequently denied the plaintiff employment based upon the findings. The issue here lies not within the plaintiff’s inability to get a job at the establishment, but in the manner in which the diner chain handled the situation. Waffle House violated the Fair Credit Reporting Act (FCRA) when a detailed background check was conducted, which Waffle House should have done with a written statement. The hiring manager should also have notified the plaintiff of his status as ineligible for hire based upon the findings of the background check in question. Had Waffle House notified the plaintiff of what they found, he would have possibly been able to address any inaccurate information presented.
